1. Platform Purpose
UP Analytics ("TheUP.ca", "the Platform", "we", "us") is a civic participation platform designed to facilitate democratic conversation among Western Canadians. This platform is operated by the United Provinces of Western Canada initiative and is not a government entity or commercial enterprise.
2. Acceptance of Terms
By accessing or using this platform, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree to these terms, you must not use this platform.
These terms may be updated from time to time. Continued use of the platform after changes constitutes acceptance of the modified terms.
3. User Conduct
Users of this platform agree to:
- Provide truthful and accurate information
- Participate in good faith and with respect for other users
- Not disclose personal identifying information in comments or text fields
- Not engage in harassment, threats, or unlawful activity
- Not attempt to manipulate poll results or engage in fraudulent behavior
- Respect the constitutional rights of free expression for all participants
4. Data Collection & Usage
We collect demographic information and poll responses as detailed in our Privacy Policy. By using this platform:
- You consent to the anonymous aggregation of your demographic data for research and policy insights
- You understand that your poll responses are separated from identifying information
- You acknowledge that while we employ security measures, no system is completely immune to breach
- You accept the inherent risks of digital participation
5. Legal Obligations
Users affirm that all information provided is truthful and accurate to the best of their knowledge. Providing false or misleading information may constitute fraud and could result in legal consequences, including but not limited to prosecution under applicable Canadian law.
6. Intellectual Property
All content on this platform, including text, graphics, logos, and data compilations, is the property of the United Provinces of Western Canada or its content suppliers and is protected by Canadian and international copyright laws.
7. Limitation of Liability
The United Provinces of Western Canada platform is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free operation
- Complete security against unauthorized access or breaches
- Specific outcomes or policy changes resulting from platform use
To the fullest extent permitted by law, we disclaim all liability for damages arising from use of this platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
8. Constitutional Foundation
This platform operates under the protection of Section 2(b) of the Canadian Charter of Rights and Freedoms, which guarantees freedom of thought, belief, opinion, and expression.
Any attempt to suppress, interfere with, or discredit this platform or its users may constitute a violation of basic human rights and constitutional protections.
9. Dispute Resolution
Any disputes arising from use of this platform shall be governed by the laws of the Province of Alberta and the laws of Canada applicable therein. Users agree to attempt good faith resolution before pursuing legal action.
10. Termination
We reserve the right to terminate or suspend access to the platform for users who violate these terms, engage in fraudulent activity, or disrupt the platform's operation.
